The ongoing saga of Overstock.com and its lawsuit against Rocker Partners and Gradient Analytics, an independent research firm, continues. As expected, the California Superior Court of Marin County this week denied motions by both Rocker and Gradient to dismiss the case under California's Anti-SLAPP law. The defendants immediately appealed.
The California law is designed to safeguard freedom of speech in a public forum, protecting individuals or companies against "strategic lawsuits against public participation," or SLAPP. One issue in this case is whether or not statements made in Gradient's research, allegedly in collaboration with Rocker Partners, were true.
